General Terms and Conditions
These General Terms and Conditions (“GTC”) sets out the general conditions of the participation in “The ScaleupFest 2023” Event (“Event”) organised by Absolvo Consulting Kft. (registered seat: 1124 Budapest, Csörsz u. 45; company registration number: Cg.01-09-918887; „Organiser”) on 20th September 2023.
These GTC shall govern the participation in the Event. The prevailing GTC, the price list – the description and price of the tickets – , and the data protection policy are available on the webpage https://thescaleupfest.com/. The Organiser does not send specific notification on the amendment of the GTC.
1. Effect of the GTC, concluding the legal relationship
The personal effect of these GTC covers the Organiser and everyone participating in the Event under any legal title.
These GTC shall be effective until 21 September 2023.
The Organiser reserves the right to amend these GTC unilaterally.
The governing language of the agreement between the Organiser and the participants of the Event is Hungarian, does not constitute a written agreement.
The participants by purchasing a ticket to the Event, or by attending the Event under any other legal title accept these GTC.
The Organiser sells the ticket for attending the Event to the participants, the agreement shall be considered performed by the payment of the purchase price of the ticket and sending the ticket electronically as a QR code.
2. Ticket purchase
The tickets can only be purchased by filling out the registration form and completing the purchase process on the webpage https://thescaleupfest2023.ticketninja.io/
The ticket purchaser declares that the data provided during the registration, purchase and payment processes are true and correct. The Organiser does not examine the truth and correctness of the data provided by the purchaser, the Organiser excludes any liability for damages arising from false data provision. The Organiser performs its obligations and issues its invoice based on the data provided by the purchaser. The Organiser reserves the right to delete the obviously false or incorrect data and in case of doubt to check the data provided by the purchaser.
The ticket purchaser can pay the purchase price of the ticket by credit card via the online payment provider’s surface contracted by Organiser. The Organiser excludes any liability for any damages arising from the default or defect of the surface of the online payment provider.
The Organiser sends the ticket to the ticket purchaser following the payment of the full purchase price by e-mail as a QR code. In case of payment by bank transfer (if applicable), the date of payment of the purchase price shall be date when the full amount is credited on either the bank account of the Organiser or on the online payment provider.
If the provided e-mail address is incorrect, the Organiser shall not be obliged to try to reach the ticket purchaser in other means in order to deliver the ticket. The ticket purchaser shall be solely liable for any damages arising from providing incorrect e-mail address, or the failure to deliver the e-mail for any reason, for example, deleted e-mail account, full inbox, spam- or firewall settings.
The ticket purchaser acknowledges that each ticket is issued by the participant’s name, with individual identification, reserving the ticket is the responsibility of the ticket purchaser. The ticket purchaser or any other participants shall keep their tickets until the end of their participation in the Event.
The ticket purchaser and the other participants shall be solely liable for any damages arising from the loss, theft, incorrect printing, copying, and multiple printing of the ticket.
The ticket purchaser is entitled to prove the fact of completed ticket purchase via mobile phone during the participation in the Event.
The ticket purchase can be cancelled without any consequence before the payment is made. Following the payment of the purchase price the ticket purchaser shall not be entitled to withdraw from the ticket purchase agreement in line with Article 29 (1) l.) of Government Decree 45/2014.
Cancellation of participation, refund the ticket price after purchase:
The Organiser offers full refund of ticket price in case of cancellation and refund request until the date of 11 September 2023 providing ticket purchaser reports in written his / her request via emailing its contact indicated in the “Contact us!” session of the https://thescaleupfest.com/ website.
If so, Organiser refunds the ticket price via its online payment service provider to the same bank account where the ticket purchase and payment had been completed from. Organiser is not obliged to accept any different ways of reportings from the described above and excludes any refunds to third parties, different bank accounts, refunds in cash or in any other ways.
If the Event is cancelled for a reason attributable to the Organiser the ticket price will be refunded to the ticket purchaser.
If the Event is cancelled for a reason not attributable to the Organiser, the Organiser shall not be liable towards the ticket purchaser and the participants, and shall not be obliged to reimburse the purchase price of the ticket.
Refund in case of non-eligible ticket purchase:
If a participant buy a ticket he / she is not eligible for based on his / her status in the ecosystem, Organiser keeps the right to cancel his / her registration to the Event. In this case, Organiser refunds the ticket price with deduction of transaction handling fees via its online payment service provider to the same bank account where the ticket purchase and payment had been completed from.
3. Participation in the Event
Only the authorised persons, in the dedicated place and time shall be entitled to attend the Event. The participants shall undergo the entrance procedure applied in the respective event.
The participants of the Event shall comply with prevailing social customs and ethical rules and acknowledge the rules of participation as binding them.
The participants of Event shall refrain from any act, declaration that may infringe or endanger other persons’ personal rights, life or health.
Any business, commercial, political or marketing activity is forbidden without the prior written consent by the Organiser.
The Organiser determines the content, quantity, time, length and range of speakers of the programs of the Event with fully reserving the rights to change them. The Organiser seeks to ensure the organisation of the programs communicated before the Event, and in case of a cancellation of a program, the replacement thereof with another program. The Organiser keeps programs always updated on the webpage https://thescaleupfest.com/, but do not seek to notify the registered participants by e-mail or post a notification on the website. The Organiser excludes any liability for costs or damages arising from such change.
The Organiser shall only be liable for damages arising from wilful misconduct, life and health infringement, and excludes any liability for breach of agreement, save for the rights of the participants qualifying as consumers. The purchase price of the ticket is set with respect to such limitation of liability.
The participants of Event shall fully liable in both civil and criminal liability for any damages caused within or in connection to the Event, towards Organiser and other participants and third parties.
The Organiser excludes any liability for any damages caused by the unlawful act or omission of any participants of Event to another participant or a third person.
The Organiser shall not be liable for any damages incurring outside, on the way there or from the Event, such damages are outside the scope of the liability of Organiser, Organiser shall only be liable for the damages incurring in the place of the events of the Event, subject to the limitation set out in these GTC.
4. Photo, audio, video capturing
The Organiser forbids any photo-, video- or voice recording, utilisation or publication of the Event for the participants of the Event. The participant of the Event shall fully liable for any damages caused by his / her breaching.
The Organiser excludes its liability for any comments of a participant infringing another participant’s personal rights, or infringing public moral.
By registering and purchasing ticket to the event participant agrees that Organiser might take photos, audio and video recordings where participant might appear at. By registering and purchasing ticket to the event participant gives his / her consent to Organiser to use, publish and display these photos, audio and video records or any parts of them in any media with no limitations or restriction in time, geography or any other.
4. Other provisions
In consumer protection public administrative procedures the local government offices have competence at the first instance. The contact details of the competent local government offices are available at: http://jarasinfo.gov.hu/. The competence of the local government office can be established by the address of the consumer, the seat or branch office of the company or the place of the infringement. The claim can be submitted in any local government offices.
The participants, ticket purchasers may initiate mediation procedure against Organiser in order to settle any dispute out of court.
